Contempt Proceedings
for Unpaid Alimony

When a spouse willfully fails to pay court-ordered alimony, the receiving spouse can seek a contempt finding. A contempt proceeding can result in the court ordering payment of arrears, attorney’s fees, and in serious cases jail time. The paying spouse has the opportunity to show that the non-payment was not willful, such as a genuine inability to pay.

Brodzki Jacobs handles contempt proceedings on both sides, pursuing enforcement for the spouse who is owed support and defending the spouse who has a legitimate reason for falling behind.
