Mediation is an out-of-court process that is designed to help couples resolve the issues in their divorce, instead of leaving the most important decisions of their lives up to a Judge. A mediator is a neutral third party who facilitates the discussion in a structured way among parties and attorneys (if represented), with the goal of reaching an agreement. Mediation is confidential even from the Judge, so you are free to discuss issues freely, and offer proposals without fear that it could later be used against you in Court if you don’t reach an agreement in mediation. At trial, a judge will decide your case after hearing all of the evidence and legal argument. In mediation, the parties have the power to determine the outcome.
