Application of the H2B Visa Petition

An employer from the United States must first petition for a Nonimmigrant Worker on behalf of the foreign employees. An individual cannot file such a visa on their own volition, and the first step for the employer is to get a temporary labor certification with the United States. This step is really important for them, and here are some of them:

• Determine the availability of U.S. workers;
• Know if the employment of the foreign worker will adversely affect the job;
• Know the opportunities, wages, and working conditions of similarly employed workers in the United States;
• Assess the temporary nature of the employer’s need for the foreign worker’s services or labor;
