The Conditions in Same-Sex Divorce

In LGBTQ divorce, there are notable circumstances that the spouses must prove before the court. These are usually the following:

• The need not to live separately to be declared ‘separated;
• The existence of a malfunctioning relationship;
• The satisfaction of 12-month period;
• The actual issuance of decree of separation;
• The term and permanent separation of the divorcing couple;
• The declaration that the parties have been separated for a minimum of 12 months;
• The separation period of at least 12 months
